Terms of Use

1. Acceptance of Terms

Welcome to Mancala NEMT ("we," "us," "our," or "Company"). These Terms of Use ("Terms") govern your access to and use of the website mancala-nemt.com, our mobile applications, and all related transportation brokerage, scheduling, and related services (collectively, the "Services"). By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree to these Terms, you may not use the Services.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements and that you have the right, authority, and capacity to enter into these Terms.

3. Description of Services

Mancala NEMT provides a technology platform that facilitates the scheduling, booking, and management of non-emergency medical transportation (NEMT) between users ("Passengers" or "Healthcare Providers") and third-party transportation providers ("Transportation Providers"). We are a transportation broker, not a direct carrier. We connect users with licensed, independent transportation operators. We are not responsible for the actual provision of transportation services, which are performed solely by the independent Transportation Providers.

4. User Accounts and Registration

To access certain features, you must register for an account. You agree to:

  • Provide      accurate, current, and complete information during registration.
  • Maintain      and promptly update your account information.
  • Keep      your password secure and accept all risks of unauthorized access.
  • Notify      us immediately of any breach of security or unauthorized use of your      account.
  • Be      solely responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct we believe violates these Terms or is harmful to other users, the Services, or our interests.

5. Acceptable Use

You agree not to use the Services to:

  • Violate      any applicable local, state, national, or international law or regulation.
  • Infringe      upon the intellectual property, privacy, or other rights of any third      party.
  • Post      or transmit any content that is unlawful, harmful, threatening, abusive,      harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate      any person or entity or misrepresent your affiliation.
  • Interfere      with or disrupt the integrity or performance of the Services or the data      contained therein.
  • Attempt      to gain unauthorized access to the Services, other accounts, or computer      systems/networks.
  • Use      the Services to book transportation for any illegal purpose or in an      unsafe manner.

6. Booking and Cancellation Policy

  • Bookings: By      booking transportation through our Services, you authorize Mancala NEMT to      share your necessary personal information (as detailed in our Privacy      Policy) with the assigned Transportation Provider to fulfill the ride.
  • Cancellations: You      agree to abide by our posted cancellation policy, which may include fees      for late cancellations or "no-shows." Specific cancellation      windows and fees will be displayed at the time of booking.
  • User      Conduct: You agree to treat all drivers and personnel with      respect. We reserve the right to refuse service to anyone for abusive,      violent, or unsafe behavior.

7. Payments and Billing

If you make payments through our Services, you agree to pay all applicable fees as described at the point of purchase. All payments are processed by third-party payment processors. You agree to provide current, complete, and accurate billing information. We reserve the right to correct any pricing errors, even after payment has been requested.

8. Intellectual Property Rights

The Services, including all content, features, functionality, software, text, graphics, logos, and the overall design, are owned by Mancala NEMT or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal, non-commercial use only.

9. Disclaimers and Limitation of Liability

  • Service      "As Is": THE SERVICES ARE PROVIDED ON AN "AS      IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY      KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING      IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,      AND NON-INFRINGEMENT.
  • Limitation      of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, MANCALA      NEMT, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES,      AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,      CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES,      WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE,      GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR      USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) THE CONDUCT OR      CONTENT OF ANY THIRD PARTY (INCLUDING TRANSPORTATION PROVIDERS) IN      CONNECTION WITH THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR      ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
  • Maximum      Liability: OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM      ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, WHETHER IN      CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO      MANCALA NEMT IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE      LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mancala NEMT, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your use of the Services, or (c) your interaction with any Transportation Provider.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Insert Your State, e.g., California], without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in [Insert County and State], and you hereby irrevocably consent to the personal jurisdiction and venue therein.

  • Entire      Agreement: These Terms, together with our Privacy Policy,      constitute the entire agreement between you and Mancala NEMT regarding the      Services.
  • Severability: If      any provision of these Terms is held to be invalid or unenforceable, the      remaining provisions will remain in full force and effect.
  • No      Waiver: Our failure to enforce any right or provision of these      Terms will not be considered a waiver of those rights.

Mancala NEMT ("we," "us," "our," or "Company") is committed to protecting the privacy of individuals who use our website, mancala-nemt.com, our mobile applications, and related transportation, brokerage, and scheduling services (collectively, our "Services").     • Healthcare       Provider/Facility Information: If you are booking on behalf of a       patient, we collect your name, title, facility, contact information, and       the patient's information as authorized.
  • Demographic      Information: We may collect demographic details such as age,      gender, and marital status when you register or through surveys, primarily      to improve our services and for internal analytics.
  • Payment      Information: If you make a purchase, our third-party payment      processors collect your payment card details, billing address, and      transaction history. We only receive confirmation of payment and the last      four digits of your payment card for verification purposes.
  • Communications: When      you contact our customer support, submit forms, or respond to surveys, we      collect your contact information and the contents of your communication.
  • Event      Registration: If you register for our events (online or      in-person), we collect your name, contact details, company, title, and any      event-specific preferences.
